DELAWARE COUNTY EMERGENCY COMMISSIONER’S MEETING

March 20, 2006

The Board of County Commissioners of Delaware County, Oklahoma, met in Emergency Session on

March 20, 2006 at 8:45 A.M.  Agenda was posted March 17, 2006 at 12:25 P.M. on east entrance door. 

 

Members of the Board present were Commissioner Bruce Poindexter-Chairman, Commissioner Howard Payton-Member, and Commissioner Dave Kendrick-Member.      The Board of Delaware County Commissioners is hereby authorized to take action on the following items:

 

A motion was made by Commissioner Kendrick and seconded by Commissioner Payton to approve agenda as posted.  Roll call: Commissioner Poindexter-yes, Commissioner Kendrick-yes, Commissioner Payton-yes. Motion carried.

 

Chairman Bruce Poindexter stated that the reason for this Emergency Meeting was called was for the purpose of dealing with an emergency within Delaware County.  According to Title25 Section 304(5) states as follows: For the purposes of this act, an emergency is defined as a situation involving injury to persons or injury and damage to public or personal property or immediate financial loss when the time requirements for public notice of a special meeting should make such procedure impractical and increase the likelihood if injury or damage or immediate financial loss.

 

A motion was made by Commissioner Kendrick and seconded by Commissioner Payton to meet with District Conservationist-Eric Daniels with the United States Department of Agriculture Natural Resources Conservation Service to discuss an Emergency Watershed Protection Project for the benefit of the Eucha-Spavinaw Watershed –Cloud Creek Branch with possible action to be taken as a result of the recent storm damage in Delaware County which has created a situation involving injury to persons or injury and damage to public or personal property or immediate financial loss. 

Mr. Eric Daniels presented to the Delaware County Board of Commissioners a Project Agreement for Emergency Funding through the Natural Resources Conservation Service to clean up debris, due to a tornado on March 12, 2006; that threatens a bridge on Hwy. 116 which crosses Cloud Creek and to clean up several destroyed poultry houses that pose a significant environmental threat to Eucha/Spavinaw watershed in Delaware County, OK.  The county does not have sufficient funds to do the repairs and has at present no other funds available.  Estimated cost for the project  is $166,250.00. In-kind contribution (25%), is estimated at $50,000.00 from Delaware Co.  Estimated costs to NRCS (75%) is $116,250.00.  Motion was made to approve and sign project agreement with NRCS.  Roll call: Commissioner Poindexter-yes, Commissioner Kendrick-yes, Commissioner Payton-yes. Motion carried.
