DELAWARE COUNTY COMMISSIONERS MEETING

May 17, 2010

The Board of County Commissioners of Delaware County, Oklahoma, met in Regular Session on May 17, 2010 at 9:00 A.M and recessed at 12:00 PM.   Agenda was posted May13, 2010 at 9:09 AM on east entrance door and the south west entrance. 

 

Members of the Board present were Chairman-Commissioner Ken Crowder, Commissioner  Dave Kendrick –Member and Commissioner Billy Cornell – Member.   The Board of Delaware County Commissioners is hereby authorized to take action on the following items:

 

AGENDA #1- A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to approve of the Agenda as posted.  Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes.  Motion carried.

AGENDA #4-A motion was made by Commissioner Cornell and seconded by Commissioner Kendrick to receive and file monthly reports from officers as follows: Co. Treasurer.  Roll call:  Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner  Kendrick–yes.  Motion carried.

 

AGENDA #5-A motion was made by Commissioner Crowder and seconded by Commissioner Kendrick to receive/file/discuss any reports from engineers for Delaware County road/bridge projects.  Tim McCrary of Rose & McCrary gave updates on road/bridge projects.  Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. Motion carried.

 

AGENDA #6- A motion was made by Commissioner Cornell and seconded by Commissioner Kendrick to open and review all bids submitted on the purchase of weather radios for the Delaware Co. Emergency Mgt. with possible acceptance of lowest or best bid.  The bids submitted are as follows: Hayes Electronics(Radio Shack)-$22.49 per radio; Radio Shack-Grove-$29.00.  The lowest bid from Hayes Electronics (Radio Shack-Siloam Springs) was accepted.  Roll call: Commissioner Crowder-yes,  Commissioner Cornell-yes, Commissioner Kendrick – yes. Motion carried.

 

AGENDA #7-A motion was made by Commissioner Crowder and seconded by Commissioner Kendrick to open and review all bids submitted on selling of Rescue Truck for the Bernice Fire Dept. with possible acceptance of best bid.  The following bid was received from Cleora Fire Dept.  in the amount of $1500.00.  Acceptance was tabled for one (1) week 5/24/10.   Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. Motion carried.

 

AGENDA #8-A motion was made by Commissioner Crowder and seconded by Commissioner Kendrick to discuss with possible action the application for a  site reclamation with DEQ.  Asst. DA Lelecas recommended that a preliminary assessment be requested from DEQ on the materials to be disposed of.  This should be done first before an application is completed.  Item to be researched and re-submitted to agenda for consideration at a later date.  Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. Motion carried.

 

AGENDA #9-A motion was made by Commissioner Kendrick and seconded by Commissioner Crowder  to advertise for sealed bids on HMHL for special project for Dist. #3.   Bids will be opened and reviewed for possible acceptance in regular meeting of 06/14/10 at 9:00AM in the commissioner’s meeting room Jay, OK. Bids will be received no later than 4:00Pm on 06/11/10 in the Co. Clerk’s office.  Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. Motion carried.

 

AGENDA #10-A motion was made by Commissioner Cornell and seconded by Commissioner Kendrick to approve salvage of vehicles for the Delaware Co. Sheriff’s Dept. as follows: (4) 1995 Ford Crown Victorias; (1) 1995 Chevy Camaro; (1) 1996 Ford Crown Victoria; (1) 1996 Chevy Blazer; (1) 1997 Crown Victoria; (1) 1998 Ford Crown Victoria; (1) Ford Expedition; (1) 2000 Ford Crown Victoria.  Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. AGENDA #11-A motion was made by Commissioner Cornell and seconded by Commissioner Kendrick to approve selling by sealed bids salvaged vehicles for the Delaware Co. Sheriff’s Dept.  Bids will be opened and reviewed for possible acceptance of best bid in regular meeting of 06/14/10 at 9:00AM in the Commissioner’s meeting room Jay, OK.  Bids will be received no later than 06/11/10 at 4:00PM in the Co. AGENDA #12- A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to approve of the appointment of Patricia Heise to the Library System’s Board of Trustees for the Eastern Oklahoma District Library System.  Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. Motion carried.

 

AGENDA #13-A motion was made by Commissioner Cornell and seconded by Commissioner Kendrick to approve of transfer of funds for the Delaware Co. Clerk’s Dept. as follows: From CCLF-3(Lien Fee) into CCLF-2 (M&O) $748.76.  Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. Motion carried.

 

AGENDA #14-A motion was made by Commissioner Kendrick and seconded by Commissioner Cornell to approve of signing of REAP contract #002-EF-2010 and resolution authorizing application for financial assistance in the amount of $50,000.00 for the annex building roof.  Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. Motion carried.

AGENDA #16-A motion was made by Commissioner Crowder and seconded by Commissioner Cornell to approve signing of 324-A claim requesting payment to Rose & McCrary, PC for engineering fees on Fly Creek Bridge #J2-4864 (005) RB in the amount of $13,006.50.  Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. Motion carried.

 

AGENDA #17-A motion was made by Commissioner Crowder and seconded by Commissioner Cornell to go into executive session, upon advice of  legal counsel for the purpose of confidential communications between the Board of Co. Commissioners of the County of Delaware Co. and it’s attorney concerning the federal lawsuit of Robert Goforth-plaintiff vs Board of Co. Commissioners of Delaware Co.-defendant, US District Court for the Northern District of Oklahoma, case #09-CV-203-CVE-TLW public disclosure of these confidential communications would seriously impair the ability of the Board and it attorney to properly process and defend this litigation. As such the communications in this Executive session are confidential.  Authority : Title 25 Oklahoma statute, sec. 307(B) (4).  Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. AGENDA #18-A motion was made by Commissioner Crowder and seconded by Commissioner Cornell to return to regular session and vote to temporarily recess the executive session and re-convene the executive session in Tulsa, OK at the US Courthouse, 333 W. 4th Street, before adjunct settlement Judge R. Scott Savage, for purposes of  a court ordered settlement conference on May 19th, 2010 in the litigation matter of : Robert Goforth-plaintiff vs Board of Co. Commissioners of Delaware Co. defendant, US District Court for the Northern District of Oklahoma, case #09-CV-203-CVE-TLW. Authority: Title 25 Oklahoma Statute, sec. 307 (B) (4). Roll call: Commissioner Crowder-yes, Commissioner Cornell-yes, Commissioner Kendrick – yes. Motion carried.
