DELAWARE COUNTY COMMISSIONERS SPECIAL MEETING

October 19, 2011

 

The Board of County Commissioners of Delaware County, Oklahoma, met in Special Session on October 19, 2011 at 4:00 P.M.  The meeting was adjourned at 6:50 P.M.  Agenda was posted on October 17, 2011 at 2:35 P.M. on east entrance door and the south west entrance.

 

Members of the Board present were  Chairman-Doug Smith, Commissioner Billy Cornell-Member, Commissioner Danny Duncan–Member.  Carol Fortner-Secretary was absent.  The Board of Delaware County Commissioners is hereby authorized to take action on the following items:

 

AGENDA #1-A motion was made by Commissioner Duncan and seconded by Commissioner Cornell to approve agenda as posted.   Roll call: Commissioner Smith-yes, Commissioner Cornell-yes, Commissioner Duncan-yes.  Motion carried.

 

AGENDA #2-A motion was made by Commissioner Duncan and seconded by Commissioner Cornell that the Board of Commissioners of Delaware CO. is hereby authorized: Sherry England, et al, Plaintiffs, vs Sheriff of Delaware Co. in his official capacity defendant, United States District Court for the Northern District of Oklahoma, case #09-CV-407-JHP TLW to go into Executive Session  upon the legal advice of legal counsel, for the purpose of confidential communications between the Board of CO. Commissioners of Delaware Co. and its attorney concerning the lawsuit previously referenced.  Public disclosure of these confidential communications would seriously impair the ability of the Board and its attorney to properly process and defend this litigation. As such the communications in this Executive Session are confidential, authority Title 25 Okla. Statutes, sec. 307(B)(4).   Roll call: Commissioner- Smith-yes,  Commissioner Cornell-yes, Commissioner-Duncan-yes. Motion carried.

 

AGENDA #3-A motion was made by Commissioner Duncan and seconded by Commissioner Cornell to return to regular meeting. No action was taken at this time related to Executive Session for Sherry England, etal, plaintiffs, vs Sheriff of Delaware Co., in his official capacity defendant, United States District Court for the Northern District of Oklahoma, case # 09-CV-407-JHP-TLW.

 

Agenda #4- A motion was made by Commissioner Cornell and seconded by Commissioner Duncan to adjourn meeting.  Meeting was adjourned at 6:50 P.M.   Roll call: Commissioner Smith-yes,   Commissioner Cornell-yes, Commissioner Duncan-yes.  Motion carried.
