DELAWARE COUNTY COMMISSIONERS’ MEETING

EMERGENCY MEETING

March 10, 2004

The Board of County Commissioners of Delaware County, Oklahoma, met in an emergency session on March 10, 2004 at 10:30 A.M.  Agenda was faxed to ten different radio stations and newspapers to make the public aware of this meeting.

Members of the Board present were Commissioner Bruce Poindexter-Chairman, Commissioner Dave Kendrick – Member, and Commissioner Howard Payton-Member.

The Board of  Delaware County Commissioners is hereby authorized to take action on the following items:

Chairman Bruce Poindexter read aloud Title 25 Section 304 (5) as follows:  An Emergency Meeting is any meeting called for the purpose of dealing with an emergency.  For the purposes of this act, an emergency is defined as a situation involving injury to persons or injury and damage to public or personal property or immediate financial loss when the time requirements for public notice of a special meeting should make such procedure impractical and increase the likelihood of injury or damage or immediate financial loss.

 

A motion was made by Bruce Poindexter seconded by Dave Kendrick to receive/approve and file letter of resignation from Lenden Woodruff, Sheriff of Delaware County effective March 9, 2004 at 4:00 p. m.  The letter of resignation read as follows:

I would like to take this opportunity to thank all of the citizens of Delaware County for their support in me as their sheriff for over the past three years.  I have recently acted inappropriately as your sheriff and hold myself accountable for my actions.

 

Over the past few days, I have seen how my actions have negatively effected the wonderful people of this county, and I therefore on my own free will ask for you to accept this letter as my formal resignation as the Delaware County Sheriff, effective immediately.

Roll Call: Commissioner Poindexter-yes, Commissioner Kendrick-yes, Commissioner Payton-yes.  Motion carried.

 

A motion was made by Commissioner Kendrick and seconded by Commissioner Payton that the Board of County Commissioners go into Executive Session pursuant to Title 25 Section 307 (B) (1) to discuss appointment of acting sheriff for Delaware County.  This statute reads as follows: Concerning the discussion of the employment, hiring, appointment, promotion, demotion, disciplining or resignation of any individual salaried public officer or employee. Roll Call: Commissioner Poindexter-yes, Commissioner Kendrick-yes, Commissioner Payton-yes.  Motion carried.

 

A motion was made by Commissioner Payton seconded by Kendrick that the Board of Commissioners of Delaware County return to regular meeting with possible action as appointment of acting sheriff effective immediately.  The choice for Acting Sheriff is Rick White, Undersheriff, of Delaware County.  This appointment will be until applications can be taken and reviewed for the position to be filled for the unexpired term. Roll Call: Commissioner Poindexter-yes, Commissioner Kendrick-yes, Commissioner Payton-yes.  Motion carried.

 

Chairman Poindexter asked if there were any questions.  A question from the audience was asked regarding Rick White’s wife, Tammy White.  The question was in regards to whether  she was going to continue working for the sheriff’s office or leave immediately.   The reply was she was looking for a job and will leave the sheriff’s office in the near future.

 

Commissioner Poindexter made the statement to the audience that he hopes that the citizens of Delaware County can come together for the good of the community.
