DELAWARE COUNTY COMMISSIONERS

SPECIAL MEETING

June 22, 2005

The Board of County Commissioners of Delaware County, Oklahoma, met in Special Session on June 22, 2005 at 2:00 P.M. Agenda was posted June 20, 2005 at 2:02 P.M. on east entrance door.

Members of the Board present were Commissioner Bruce Poindexter-Chairman , Commissioner Howard Payton-Member, and Commissioner Dave Kendrick-Member. County Clerk –Carol Fortner was absent. The Board of Delaware County Commissioners is hereby authorized to take action on the following items:

A motion was made by Commissioner Kendrick and seconded by Commissioner Payton to approve agenda as posted. Roll call: Commissioner Poindexter-yes, Commissioner Payton-yes, Commissioner Kendrick-yes. Motion carried.

A motion was made by Commissioner Payton and seconded by Commissioner Kendrick to go into Executive Session in regards to litigation of MIDA case #CJ-2005-276 and case #05CV-0297TCK-PJC. Roll call: Commissioner Poindexter-yes, Commissioner Payton-yes, Commissioner Kendrick-yes. Motion carried.

A motion was made by Commissioner Kendrick and seconded by Commissioner Payton to return to regular meeting. Roll call: Commissioner Poindexter-yes, Commissioner Payton-yes, Commissioner Kendrick-yes. Motion carried.

The motion to receive and forward MIDA paperwork to attorney was tabled until June 27, 2005 per recommendation of Asst. DA Lelecas.

New Business: None submitted.

PUBLIC COMMENT: None submitted.

There being no further business to discuss, the meeting was recessed.
